			<description>Orderd brown Zune from Dell on 11/23. Called 2 weeks later after receiving confirmation of order and they tell me they are out of stock. I explained they had plenty when I ordered &amp; paid for it and insisted I better have one within the next week as it was a gift. I received it on 12/17 but not a brown one..it was white. I called and they told me they no longer carried the brown so they replaced it with a white one. I could return if I chose to. - Vickie</description>

			<description>Ordered a brown zune on 11/23. Received a shipping date of 12/10. Went back to order a second one later that day and had shipt date of 2/1/08 so I canceled it. After searching the net and finding all brown zunes out of stock, I figured that was the end of my cheap zune purchase. Received a delayed shipping email stating new date of 12/17. Got on live chat with Dell and explained situation. Told them it was a present and I was worried that item not in production would not be received by Dell for my order. CS rep checked order and told me the Zune shipped on the 8th and the fm transmitter was the item backordered. Tracking number with DHL said delivery today, called and with the snow and ice up north it was delayed and will be here tomorrow.

			<description>I ordered 2 of the $96 brown Zunes on 11/24/07.  When I received my order confirmation email it showed the estimated ship date of 2/1/08.  That doesn't do me a lot of good for my kids’ Christmas gifts, but I have not cancelled the order.  I’m now looking at getting the 8 GB Zunes for my kids and waiting for the 30 GB for me and my husband.  Anyway, after I read these posts, I had to check my order on the Dell site.  Everything is still the same.  But now I will check on it regularly.

			<description>I swear, Messed-over Okie, I thought your message came from my wife and she picked an unusual handle. Your comment is verbatim what she would have posted based on her experience, down to the same dates and that it was a present for our Son.

On Nov 23, she ordered the brown Zune from Dell and received a confirmation for Nov 27 ship date. Later the ship date was changed to Dec 12. Just recently, the order was canceled.

However, the reasons Dell listed for cancellation are different. They gave two reasons:

&lt;b&gt;Customer requested cancellation&lt;/b&gt; and
&lt;b&gt;Legally required to cancel due to customer not responding to shipment delay notice&lt;/b&gt;

The second reason is laughable. First due to the fact that their first reason would normally be enough, if it was true. However, she never intended to cancel or even called to do so. Second, what's the legal requirement for this action? The e-mail that was sent informing a delayed shipping date states that &lt;b&gt;customer doesn't need to respond to accept shipping delay&lt;/b&gt;.

She has been on the phone, daily, to resolve the issue. She contracted to buy a Zune for $96. She did not request cancellation. They did not inform her of stock issues or any other &quot;reasonably assumable&quot; issues that prevent Dell from fulfilling the order. They allowed the order to be initiated. It was in stock at the time of the order, now they need to remedy the situation. They should at least sell one of the other color models at the same price as a suitable substitution.

If you plan a rebuttal to my comment, nobody should quote their terms of sale policies including reasons they can cancel orders at will. I read the terms that were linked to in the initial order e-mail. It refers to a page on their website which has many paragraphs that the consumer is bound to, including Dell's ability to cancel orders and their binding arbitration requirements. However, prefacing those paragraphs is an initial disclaimer containing the following text:

&lt;b&gt;By accepting delivery of the Product, you accept and are bound to the terms and conditions of this Agreement.&lt;/b&gt;

The whole agreement is what they use to bind the transaction. If you didn't notice at first glance, it states &quot;&lt;b&gt;By accepting delivery of the Product&lt;/b&gt;&quot;

She didn't accept delivery yet. So I guess she's not bound by the agreement until it's sent. In black and white, I suppose standard laws of interstate commerce now apply. Or since they are licensed do business in our state also, state laws may also apply.

All she's asking is for Dell to un-cancel the order (because their reasons have no merit) and if needed, they should substitute a comparable product. - Relayer</description>

			<description>I ordered this from Dell on 11-23-07.  They said it was in stock and would ship on or about 11-27.  I checked the order status today (12-3) and they had moved the shipping date to 12-17.  I was concerned that the Zune would not be here for Christmas and called.  I ended up speaking with two different reps (both located in INDIA!).  The second informed me that there had been a &quot;pricing error&quot; and that all Zune orders were going to be cancelled on Monday, Dec. 3.  

Dell has REALLY screwed me over with this order cancellation.  I don't know what I'm going to end up buying my son for Christmas.  I will NEVER do business with Dell again.  I hope you don't either! - Messed-over Okie</description>
